The mandatory property diagnosis is a concern during a move. Since 1996 (source www.3ehabitat.fr), these property evaluations are the responsibility of the owner who sells or rents. They must inform the future occupant about the premises and be able to work with them. Indeed, these diagnostics can influence the price or the chances of selling their property. However, they prevent disputes and improve the quality of living space. Let’s take stock of these mandatory or optional diagnostics.
Mandatory Diagnosis in Case of Sale
The mandatory property diagnostics are included in the purchase deed in the form of a unique technical diagnosis, but they only have informative value. Since January 1, 2013, there have been eight:

- the risk of lead exposure (CREP) in properties built before January 1, 1949 (permanent validity with a single diagnosis);
- the presence or absence of materials containing asbestos (permanent validity with a single diagnosis);
- the presence of termites for all buildings concerned by prefectural regulations (validity 6 months);
- the state of the natural gas installation if the installation is over 15 years old (validity of 3 years);
- the status of natural and technological risks (NTR) by zones (validity of six months);
- the Energy Performance Diagnosis (DPE) provides energy information about the building, its energy consumption (validity of ten years);
- the electrical diagnosis if the installations are over 15 years old (validity of 3 years);
- the sanitation diagnosis to inform about the existence and proper functioning of a collective network. Non-compliance with the regulations in force after the diagnosis can be required by the Seller for the execution of the work.
Mandatory Property Diagnosis for Rental
All owners must provide their tenants with a technical property diagnosis file (DDT) including the CREP, the ERT, and the DPE (see above). It should be noted that the ERT is only valid for six months, while the DPE is valid for 10 years. If the DDT is not provided, the tenant may request a modification of their rent price.
Optional Property Diagnosis
The quality of water networks, the presence of legionella or radon can be taken into account in property evaluations. Take the opportunity to check the safety standards of your new pool or the pool you are selling. In short, property evaluations are a guarantee against hidden defects and promote sustainable habitats. The timing of the move is sometimes interesting for carrying out the necessary work.
